The fine print, in plain words.

1. Who we are

These terms are an agreement between you and Wissam Elmasry, an individual trading as WishNap (“we”, “us”), about the WishNap app for iPhone and this website. The app includes its Share sheet extension, widgets and Live Activity, and the Screen Time extensions that run quiet hours for shops. WishNap isn’t an incorporated company, and no postal address is published: email support@wishnap.com about anything (see section 16).

These terms sit alongside Apple’s Standard EULA, which you accept when you get WishNap from the App Store (see section 2), and add what’s specific to WishNap, such as how WishNap Pro works. If you don’t agree with them, please don’t use WishNap.

2. Your license

WishNap is licensed, not sold, to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”), which is part of these terms. These terms add what’s specific to WishNap. If the two ever conflict, the Standard EULA governs your license to use the app.

As the Standard EULA explains, we, not Apple, are responsible for WishNap, its content and its support.

3. WishNap Pro subscriptions

WishNap is free to download. The core of it is free: parking things from the Share sheet or by hand, their cooling-off timers, the wake-up question and its notifications, your answers (let it go, bought or snooze), and your “not spent” total. These don’t need a subscription.

WishNap Pro is an optional auto-renewing subscription that adds more:

• Payment is charged to your Apple ID account at confirmation of purchase. If you start with the free trial, the first payment is charged when the trial ends, unless you cancel before then.
• Automatic renewal. Your subscription renews automatically for the same length at the price of your plan, unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for the renewal within the 24 hours before the current period ends.
• Managing and canceling. You can manage or cancel your subscription in your Apple ID account settings at any time after purchase. On iPhone: Settings, tap your name, then Subscriptions. Canceling stops the next renewal; Pro stays on until the end of the period you’ve paid for.
• Free trial. The 7-day free trial is on the annual plan only, for Apple IDs that haven’t used it before. Any unused portion of a free trial is forfeited when you buy a subscription. If notifications are on, WishNap reminds you 2 days before the trial ends; please don’t rely on that reminder alone.
• For one person. Subscriptions are for individual Apple IDs. WishNap Pro isn’t shared through Family Sharing, and it isn’t offered for organizations to buy for their members.
• Restoring. Your subscription belongs to your Apple ID. Restore it on another iPhone with the same Apple ID, from the plans screen in WishNap.

4. Canceling and refunds

Payments are handled by Apple, so we can’t cancel a subscription or issue a refund ourselves. Apple decides refund requests; you can make one at reportaproblem.apple.com. Any right you have by law to cancel or get a refund is handled through Apple too.

If your subscription ends, the Pro features lock again. Nothing you’ve saved is deleted, and the free features keep working.

5. Not financial advice

WishNap is a tool for pausing before you buy. Its timers, questions, totals, patterns and estimates are prompts to help you think. They aren’t financial, investment, tax, legal, medical or psychological advice, and WishNap isn’t a budgeting, banking or payment service.

Every decision about what to buy is yours. The “not spent” total and the other figures in WishNap are based only on what you enter, so they aren’t a record of your actual finances. We aren’t responsible for purchases you make or don’t make, or for prices, stock or offers that change while something is parked.

6. Your content

What you put into WishNap, such as items, notes and goals, is yours. It’s stored on your iPhone and, if you use iCloud, in your own iCloud. We don’t have access to it, so we can’t restore it if it’s lost. Export a copy from Settings any time (product photos aren’t included). How WishNap handles data is set out in the privacy policy.

7. Shops, links and quiet hours

WishNap isn’t affiliated with the shops you park things from. Product names, prices and photos come from the pages and apps you share, may be incomplete or out of date, and belong to their owners. Opening a link takes you to the shop’s own site or app, where its terms apply.

Quiet hours for shops, part of WishNap Pro, use Apple’s Screen Time to rest the shopping apps and websites you choose, during the hours you set. They’re a pause, not a lock: “Let me through anyway” always gets you through, after a short breath if you chose “Pause first”. They work only as far as Screen Time on your iPhone allows, so please don’t count on them to stop a purchase.

8. Using WishNap fairly

WishNap is for your own personal, non-commercial use. Please don’t misuse it: don’t try to break, overload or get around its features or its subscriptions, and don’t use it to break the law. The Standard EULA sets out the rest of what the license does and doesn’t allow.

9. Changes to the app

We keep working on WishNap, so features may change over time. Some depend on Apple, such as iCloud, notifications, Screen Time and the App Store, and may change or stop when Apple’s services do. We can’t promise that WishNap will always be available or free of errors.

10. Disclaimer

If you live in Quebec: this section doesn’t apply to you where the Consumer Protection Act doesn’t allow it.

To the extent the law allows, WishNap is provided “as is” and “as available”, without warranties of any kind beyond those in the Standard EULA and those the law doesn’t let us exclude.

11. Limitation of liability

If you live in Quebec: this section doesn’t apply to you where the Consumer Protection Act doesn’t allow it.

To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential losses, or for lost profits, data or goodwill, arising from your use of WishNap. Our total liability for any claim relating to WishNap is limited to the amount you paid for WishNap in the 12 months before the claim.

Nothing in these terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, or for fraud. Nothing here takes away the consumer rights in section 12.

12. Consumer rights we don’t limit

Nothing in these terms takes away a right you have that can’t be taken away. In particular:

• In the EU, the EEA, the UK and Switzerland, your statutory rights as a consumer apply in full, whatever the other sections say. That includes any right to withdraw from a purchase and your remedies if WishNap isn’t as described.
• In Quebec, the Consumer Protection Act applies in full. Anything in these terms that it prohibits, including limits on liability it doesn’t allow, doesn’t apply to you.
• Everywhere else, any consumer protection your local law doesn’t let you give up still applies, whatever these terms say.

Where one of these rights and these terms conflict, the right wins.

13. Which law applies

These terms don’t choose any country’s law or courts. Which law applies, and where a dispute would be heard, is decided by the usual rules for where you live. In Quebec, the EU, the EEA, the UK and Switzerland, those rules protect consumers, and nothing here is meant to change that.

There’s no arbitration clause and no class-action waiver. Nothing here takes away your right to go to court, or to join others who do.

If something’s wrong, please write to support@wishnap.com first. Most things are quicker to fix than to argue about.

14. Changes to these terms

We change these terms only for a reason: a change to WishNap’s features, to how WishNap Pro works or what it costs, to the law, or to Apple’s rules for the App Store. Every change updates the date at the top of this page.

If a change reduces your rights or adds to what you pay, we’ll tell you in WishNap and on this page at least 30 days before it takes effect, showing the new wording, the old wording and the date it starts. If you don’t accept it, you can cancel your subscription in your Apple ID settings before then, at no cost, and stop using WishNap. Other changes, such as clearer wording, take effect when we post them here.

WishNap and this website use some open-source software, under these licenses:
